Don't let your insurance company pressure you into using their preferred body shop. Know your rights.

In the state of Texas, YOU have the right to choose the auto body repair shop that repairs your vehicle.

Your insurance company may give you a list of preferred or recommended body shops, but they cannot require you to use one of those shops. Texas law protects your right to select the repair facility of your choice.

Here's what Texas law says:

Texas Insurance Code § 1952.301 provides that an insurer may not limit coverage under an automobile insurance policy by limiting the claimant's ability to select a repair person or facility to repair damage to the vehicle.

Texas law also prohibits an insurer, its employees, agents, or adjusters from stating or suggesting to a claimant that they must use a specific repair facility or a repair facility from the insurer's preferred list in order for the repairs to be covered.

The Texas Department of Insurance confirms:

“You have the right to choose the repair shop and parts for your vehicle.”

And TDI specifically states that while an insurance company may provide a list of body shops, “they can't require you to use a shop on its list.”

If your insurance company is telling you otherwise, ask them to provide that requirement in writing and contact the Texas Department of Insurance at 800-252-3439 if you believe your rights are being violated.

Insurance policies usually cover two types of damage: collision and comprehensive.

COMPREHENSIVE:

This type of damage generally will not increase your premium. It covers situations out of your control, including:

COLLISION:

Premiums may go up only if you are found to be over 49% at fault.

• Insurance companies assess fault.

• If not at fault, you won’t pay your collision deductible.

• If found not at fault after paying the deductible, you will be reimbursed.

Collision includes:

• Colliding with another vehicle

• Sliding into objects on ice

• Pothole damage

Most insurance policies cover rental cars for 15-30 days.
